Warranty Policy and Limitations

Bizplanet Solution Pte Ltd (BS) values your business and always attempts to provide you the very best of service.

No warranty is provided by BS unless your equipment was purchased from BS. Please see below for warranty information or obtaining service. No warranty service is provided unless the equipment is returned to BS where the equipment was first shipped by BS, which may have regional specific warranty implications.

Nothing in this warranty modifies or excludes your legal rights under Consumer Protection (Fair Trading) Act (CPFTA) of Singapore. This warranty identifies BS’s preferred approach to resolving warranty claims which is likely to be quick and simple for all parties.

Our goods come with guarantees that cannot be excluded under the CPFTA. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to unfair practice. What constitutes unfair practice is set out in the CPFTA.

Warranty

BS warrants that the equipment, in the course of its normal use, will for the term defined below. The term of your warranty period shall commence against defects in materials and workmanship on the purchase date appearing on your delivery order from BS for one year, unless otherwise stated during purchase. Proof of purchase shall be required to be eligible for this warranty and to establish the commencement date of this warranty. Warranty service will not be provided unless the equipment is returned to BS where the equipment was first shipped by BS. BS shall have no liability for any equipment returned if BS determines that the equipment was:

  1. Not used in accordance with BS or manufacturer specifications and instructions.
  2. Not used for its intended function.
  3. Not purchased from BS.
  4. Stolen from BS.
  5. Asserted defect:
    1. Is not present.
    2. Cannot reasonably be rectified because of damage occurring before BS receives the equipment.
    3. Is attributable to misuse, improper installation, alteration, accident or mishandling while in the possession of someone other than BS.

If the equipment is not of a kind ordinarily acquired for personal, domestic or household use or consumption, provided it is fair and reasonable to do so, BS limits its liability to replacement of the equipment.

This warranty shall extend to repaired or replaced equipment for the balance of the applicable period of the original warranty from the date of delivery of a repaired or replaced equipment, whichever is longer. This warranty is BS provides warranty and is applicable only to equipment sold as new. If client insists BS to handle warranty case which is ineligible or handle equipment warranty which is not under BS liability, BS is allowed to charge client an admin fee and handling fee.

Obtaining Service

If you wish to make a claim, you should initially visit our support Web site at Support & Service for information on how to obtain service or a Return Material Authorization (RMA). If it is determined that the equipment may be defective, you will be given an RMA number and instructions for equipment return. Authorized returns must be shipped in an approved shipping container, prepaid and insured, to the address provided with your RMA number. If following purchased qualifying claim under this warranty, BS will determine that your claim is valid, BS shall, at its discretion, either repair or replace the equipment. You are responsible for any expenses associated with a claim under this warranty. The benefits provided to you under this warranty are in addition to other rights and remedies available to you under the CPFTA.

Return Material Authorization (RMA)

No equipment may be returned directly to BS without first contacting BS for a Return Material Authorization (“RMA”) number. If it is determined that the equipment may be defective, you will be given an RMA number and instructions for equipment return. An unauthorized return, i.e. After examining and testing a returned equipment, if BS concludes that a returned equipment is not defective, customer will be notified, the equipment returned at customer’s expense, and a charge made for examination and testing. Authorized returns are to be shipped prepaid and insured to the address on the RMA in an approved shipping container. Your box and packaging materials should be neat packaging for storing or shipping your equipment. If upon inspection of your returned equipment BS suspects fraud or deems such equipment to be counterfeit, BS may, in its sole discretion, confiscate such equipment or take such other actions as it deems necessary. Bs will advise of embargo country list for RMA process, if your country is not in the embargo list and you cannot create an RMA, please contact BS for equipment replacement.

Warranty Limitations

BS’s limited warranty provides that, subject to the following limitations, each equipment will be free from defects in material and workmanship and will conform to BS’s specification for the particular equipment.

Limitation of Remedies

Your exclusive remedy for any defective equipment is limited to the repair or replacement of the defective equipment.

BS may opt for which remedy or combination of remedies to provide in its sole discretion. BS shall have a reasonable time after determining that a defective equipment exists to repair or replace a defective equipment. BS’s replacement equipment under its limited warranty will be manufactured from new and serviceable used parts. BS’s warranty applies to repaired or replaced equipment for the balance of the applicable period of the original warranty from the date of shipment of a repaired or replaced equipment.

Limitation of Damages

BS’s entire liability for any defective equipment shall in no event exceed the purchase price for the defective equipment. This limitation applies even if BS cannot or does not repair or replace any defective equipment and your exclusive remedy fails of its essential purpose.

No Consequential or Other Damages

Notwithstanding anything else in this policy or otherwise, BS will not be liable with respect to the equipment under any contract, negligence, strict liability or other legal or equitable theory

  1. For any amount in excess of the purchase price for the defective equipment.
  2. For any general, consequential, punitive, incidental or special damages.

These include interruption of use, lost profits and the cost of the installation or removal of any equipment, the installation of replacement equipment, and any inspection, testing, or redesign caused by any defect or by the repair or replacement of equipment arising from a defect in any equipment. This section does not limit liability for bodily injury of a person.

Your usage of the equipment

BS will have no liability for any equipment returned if BS determines that:

The equipment was stolen from BS.

  1. The asserted defect:
    1. Is not present,
    2. Cannot reasonably be fixed because of damage occurring when the equipment is in the possession of someone other than BS, or
    3. Is attributable to misuse, improper installation, alteration (unless authorized to do so by BS), accident or mishandling while in the possession of someone other than BS.
  2. Normal wear and tear.
  3. The equipment was not sold to you as new.
  4. The equipment was not used for its intended function.
  5. The equipment was not used in accordance with BS specifications and instructions.

 

Additional Limitations on Warranty

BS’s warranty does not cover equipment which have been received improperly packaged, altered, or physically damaged. Equipment will be inspected upon receipt. Here are some examples of equipment that BS will not accepts for warranty.

Packaging

  1. Improperly packaged
  2. Non-qualified shipping container

Alterations

  1. Missing barcode
  2. No tape sealed
  3. Serial number does not match

Damage

  1. Physical damage
  2. Dented
  3. Deep scratch
  4. Loose, damaged, or missing screws

WARNING: in any application the reliability of operation of the products can be impaired by adverse factors, including but not limited to:

  1. Fluctuations in electrical power supply.
  2. Computer hardware malfunctions.
  3. Computer operating system software fitness, fitness of compilers and development software used to develop an application.
  4. Installation errors.
  5. Software and hardware compatibility problems.
  6. Malfunctions or failures of electronic monitoring or control devices.
  7. Transient failures of electronic systems include of hardware and/or software.
  8. Unanticipated uses or misuses, or errors on the part of the user or applications designer (adverse factors such as these are hereafter collectively termed “system failures”).

Any application where a system failure would create a risk of harm to property or persons, including the risk of bodily injury and death, should not be reliant solely upon one form of electronic system due to the risk of system failure.

To avoid damage, injury, or death, the user must take reasonably prudent steps to protect against system failures, including but not limited to back-up or shut down mechanisms. because each end-user system is customized and differs from BS’s manufacturer testing platforms and because a user may use BS equipment in combination with other products in a manner not evaluated or contemplated by BS, the user is ultimately responsible for verifying and validating the suitability of BS equipment whenever BS equipment are incorporated in a system or application, including, without limitation, the appropriate design, process and safety level of such system.
